Greystar โ the largest apartment manager in the U.S. โ has reached a consent decree with the DOJ over its use of RealPageโs rent-setting software.
Under the deal, theyโll drop any pricing tools using competitor or nonpublic data, stop sharing rental data with other landlords, avoid RealPage events, and cooperate in the ongoing antitrust investigation.
No admission of wrongdoing, but theyโve got 180 days to comply.
Likely Impacts:
Revenue management goes manual โ Operators will have to rebuild pricing processes without the algorithmic โliftโ theyโve relied on for years.
No more comp calls โ A decades-old practice of calling competitors for pricing intel is effectively dead. Now, operators can only rely on publicly posted online pricing.
Wave of copycat legislation โ 22 states already have 40 bills targeting rent-setting algorithms, with more to come.
Data vendor pivot โ Expect a rush of โDOJ-safeโ pricing tools that avoid nonpublic data, paired with court-approved monitoring.
Litigation floodgates open โ Class action lawyers now have a roadmap; even operators outside the DOJ case could face lawsuits.
When the government changes the rules, the players who adapt fastest donโt just survive โ they quietly take market share.
